The possession of this catalog is not an offer on our part to sell until such time your status in the trade is properly established. Identification is required from all purchasers. To have a credit aplication faxed or mailed to you, click here TERMS Credit department approval is required before open account sales may be made to any new customers or reinstatement of formerly inactive customers. All sales prior to credit department approval will be made on a cash basis. Terms of payment are 30 days from date of invoice. Any customer whose account becomes past due will be handled on a COD basis until the account is current. Once current, any return to a delinquent status will return the customer to the COD basis. A 1-1/2 percent per month service charge will be charged on all unpaid balances 30 days and over. If in the sellers judgement the financial condition of the buyer at the time products are ready for shipment does not justify the payment terms specified, seller reserves the right to require full payment in cash before shipment or delivery. In the event buyer defaults in payment, buyer shall be liable for all collection cost incurred by seller inducing but not limited to attorney and collection agency fees. SHIPPING Shipping dates given in advance of actual shipment are estimated and deliveries will be made subject to prior orders on file with seller, Seller shall not be liable for failure to perform or delay in performance resulting from fire, labor difficulties, major changes in economic conditions, or any cause beyond sellers reasonable control. Freight will be determined and charged to our customers unless otherwise specified by seller. CLAIMS Claims for shortages must be made within 48 hours of receipt of shipment or claim will be denied. When merchandise is accepted in good condition, this merchandise becomes the property of the consignee, and any claims arising from loss or the consignee must file breakage with the Transportation Company. RETURNED MERCHANDISE Our authorization must be obtained before returnable goods will be accepted. All items must be returned on our issued Return Goods Authorization Tag. Always refer to invoice number and date of original purchase. Such returns are subject to a minimum restocking charge of 20 percent. Materials made or cut to special order, materials altered by buyer, or materials or merchandise that are not or cannot be put in first class stock condition are not returnable. Credit cannot be issued until our invoice number is known. Advise us of this number at the time of return to avoid delay in issuance of credit. WARRANTIES Liability of the product sold by us is limited to the manufactures standard warranty, if any, and to the value of such goods supplied. No claims will be allowed for labor or consequential damage or defects in goods. TO THE PURCHASER/ AND OR INSTALLER Installation of the heating and cooling equipment must be done by a qualified contractor in accordance with regulations of the national fire protection standard, and in complete accordance with all local codes and authorities having jurisdiction. CANCELLATIONS & CHANGES Cancellations of special order, non-stock, or direct items will not be accepted after seller has determined that such cancellation is no longer acceptable to its vendor. Changes made to an order accepted by the seller that result in cancellation of material ordered will render the buyer liable for the purchase of the material delivered or ordered by seller and deemed not cancelable by seller. Handling charges or other losses incurred by seller in return or resale of cancelled material will be charged to buyer. MODIFICATION OF TERMS Buyer's purchases will be accepted only on the exact terms and conditions set forth here and on no other terms and conditions. These terms and conditions supersede the terms and conditions of the Buyers Purchase Order. Nothing typed or printed on the buyers purchase order shall modify any of these terms.
